Understanding Deeds of Conditions

Who is it for and what is it about?

This 2-day course is for those who work within a factoring role or those who have a factoring function within their role where they will be responsible for examining deeds of conditions. It will examine the deeds of condition in detail using real life examples. We will explore the clauses within the title deeds and what restrictions these place upon the owner of the property or you as the factor.

We will also discuss why deeds would be amended and how and who can do this as well as how to use legislation where deeds are unclear or silent on a particular area where maintenance is required.  Participants may find it useful to bring deeds of conditions for properties that they currently factor, particularly if they feel that these are unclear.

Course Content

Day 1

    • The title deeds a brief history – including the abolition of Feudal tenure Act and how to make feudal deeds workable in the 21st century
    • The structure of deeds
    • How to read a deed

Day 2

    • Exploration of legislation to support when deeds are unclear or ‘silent’
    • Exploring burdens
    • Variation of deeds – who can do this and why
    • How the TMS can help where deeds are silent, using a silent deed

Learning Outcomes

By the end of this course participants will be able to:

    • Read a deed of condition and understand which “clause” or “rule” is important to providing a factoring service
    • How to use legislation where the deeds is silent on a particular issue
    • Where to access deeds and how to amend deeds
